PURPOSE
The purpose of this Site is to provide users with information enabling them to discover the activity and services offered by the Company, as well as its news (events, publications, etc.);

– To propose functionalities and/or information allowing users to contact the Company and to present the services offered by the Company, the projects realized by the latter and to come, or the team working on these projects;
– Provide users with access to the Platform and the various associated services (hereinafter the “Services”) as detailed in our terms and conditions https://www.mainbot.me/terms.

During your browsing and your interactions on the Site, on the pages administered by the Company on social networks or, in general, during your interactions or exchanges with the Company, the latter may collect and process Personal Data concerning you, for the management of the activities it carries out and on its own behalf, in its capacity as Data Controller, whether you are a customer, prospect, User, Internet user, candidate, supplier, service provider or partner, potential or actual (also referred to as ‘you’ or ‘the person(s) concerned’ or ‘the users’ in this privacy policy).

In this context, the Company applies the principles defined by the legal and regulatory provisions on the protection of personal data, in particular in Regulation (EU) 2016/679 of April 27, 2016 on the protection of individuals with regard to the Processing of Personal Data (“RGPD”) or Law 78-17 of January 6, 1978 relating to information technology, files and freedoms (known as the “Information Technology and Freedoms Law”) and its decrees.

The purpose of this Privacy Policy is to provide information on how MAINBOT, as Data Controller, collects and processes Users’ Personal Data and how Users can control such use and exercise their rights with respect thereto.

By using the Site, Users certify that they have read and understood this Privacy Policy and agree to its terms.

This Privacy Policy applies not only to the Site, but also to MAINBOT’s activity in relation to its users. The privacy policy may be subject to updates. In the event of significant changes to this Privacy Policy, Users will be required to clearly express their consent to such changes, failing which they will be required to cease using the Services.

PERSONAL DATA PROCESSED
The collection of Personal Data is limited to the strict minimum. Consequently, only relevant, adequate and limited information is collected for the purposes for which it is processed.

Purposes of the processing :
The purpose of this Processing of Personal Data is to enable Users to benefit from the Services offered by MAINBOT and for which the Processing of Personal Data is indispensable. Thus, the collection and Processing of Personal Data by MAINBOT meet specific, explicit and legitimate purposes, namely:

Recipients of Personal Data:
With the exception of service providers used by MAINBOT to provide the Services, MAINBOT is the sole recipient of the Personal Data collected and will not sell this Personal Data without your express consent.

The Personal Data will be processed exclusively in the territory of (i) France, (ii) and/or any other member state of the European Union, (iii) and/or any other State signatory to the Agreement on the European Economic Area or Switzerland (iv) and/or any other State providing an adequate level of protection (hereinafter referred to as the “Territory”).

Apart from the cases mentioned above, any transfer of Personal Data to a third country requires the prior consent of the Users and is subject to compliance with the personal data protection laws in force.

MAINBOT may also share the Personal Data collected:

with the companies it controls or those that control it within the meaning of Articles L233-1 et seq. of the French Commercial Code, in the event of a sale, demerger, partial contribution of assets, or any other form of restructuring that it may undergo, in order to comply with its legal and regulatory obligations

Data security
MAINBOT protects and secures Personal Information to ensure its security and to prevent it from being altered, damaged, destroyed or disclosed to unauthorized parties. All persons having access to Personal Data are bound by an obligation of confidentiality.

Cookies
The Site uses technical cookies (hereinafter “Cookies”).

Right of access :
You may obtain confirmation as to whether or not your Personal Data is being processed by the Company and, if so, access to such Personal Data, as well as certain information regarding the Processing of your Personal Data and the characteristics of such Processing;

Right of rectification :
You may request the rectification of your Personal Data that you consider incomplete or inaccurate;

Right to erasure:
You may, in certain cases, request the deletion of your Personal Data (except, for example, if it is necessary for the performance of your contractual relationship with the Company, if any, or if it is necessary for the Company to comply with its legal or regulatory obligations or to know or exercise its rights) ;

Right to the limitation of the Treatment :
You may request the limitation of the Processing of your Personal Data, allowing you to request in certain cases the marking of your Personal Data in order to limit future Processing;

Right to the portability of your Personal Data:
You have the right in certain cases and under certain conditions to request to receive the Personal Data about you that you have provided to us or, where technically possible, to have it transferred to a third party in a machine-readable form (it being specified that this right to data portability applies only to Processing based on the consent of the Data Subjects or on the performance of contractual relations, provided that the Processing of the Data is carried out by automated processes) ;

Right to withdraw your consent :
You may withdraw your consent if the Processing is carried out on the basis of your consent, without the withdrawal of that consent affecting the lawfulness of the Processing based on the consent carried out prior to the withdrawal of consent;

Right to define directives for the retention, deletion or disclosure of your Personal Data after your death:

In this respect, in the event of your death which would be brought to our attention, you should know that your Personal Data will in principle be deleted (except if it is necessary to keep them for a determined period of time for reasons related to our legal and regulatory obligations), after having been communicated to a third party possibly designated by you.

In any case, in the event of reasonable doubt as to the identity of the person submitting such a request to exercise his or her rights, the Company may always ask to be provided with the additional information necessary to confirm the identity of the Person concerned and to this end request, when the situation so requires, a photocopy of an identity document bearing the signature of the holder. In such a case, the above-mentioned response deadlines will be suspended pending receipt of the additional information needed to identify the person concerned.

If such a request is received, it will be answered as soon as possible and in any case within a maximum of one month from the receipt of the request. If necessary, this period may be extended by two months, taking into account the complexity and number of applications received, in which case the applicant will be informed.

The request may be made by the Person Concerned or by a person specially empowered for this purpose by the Person Concerned, provided that such empowered person can prove his or her identity and the identity of the principal, his or her mandate and the duration and precise mandate for which it is made. The mandate must also specify whether the representative may be designated as a recipient of the response.

You also have the right to lodge a complaint with the competent supervisory authority (in France, this is the Commission Nationale de l’Informatique et des Libertés, known as “CNIL”: 3 place de Fontenoy, TSA 80715 – 75334 Paris Cedex 07; tel: +33 (0)1 53 73 22 22) if you consider that the Processing of your Personal Data is not carried out in accordance with the legal and regulatory provisions on the Protection of Personal Data.
